This website describes the services offered by "Instituto de Comunicación". In particular, this website is intended to create reports on the relational health of clients' teams, where professional users with access can pay the cost of each report directly on the website. Clients send the questionnaires they complete and "Instituto de Comunicación" creates individual reports based on those responses.

Obtaining and Processing of Personal Data

Personal data is any information relating to a person: name, email, address, telephone, NIF/NIE... In addition, when a User visits our website, certain information is automatically stored for technical reasons, such as the IP address assigned by their Internet access provider.

Minors

Only persons over 14 years of age may provide personal data on this website. As required by the LOPD and GDD, in the case of minors under 14 years of age, the consent of their parents or guardians will be a mandatory condition for us to process their personal data.

Furthermore, only persons over 18 years of age may contract our services. In the case of minors under 18 years of age, the consent of their parents or legal guardians will be a mandatory condition for us to provide the services offered, unless the minor is emancipated.

User Registration - Passwords

In order to contract the services offered on this website, private access as a User is required. To this end, after attending a training course on the use of the model and the platform, the User receives an email generated from the web platform. In this email, the User receives the access link to the website, as well as the username and password to be used for access.

In addition, the User must accept the Contract Terms, set out in another section of the website.

The User must also provide a password, which must meet certain security requirements. Passwords do not expire. To recover the password, the User must click on the "Request a new password" link and access the specific recovery form. They will only need to enter their email address to continue with the process and change it; instructions will be sent to the email address provided. The User is responsible for maintaining the confidentiality of their password, as well as for all uses made of it. They must notify "Instituto de Comunicación" of any unauthorized use of their account or password as soon as possible.

Once registered, the User is granted the "certified-user" profile and has access to a private panel where they can view certain content, records of purchases or contracts entered into, etc. They can also manage account options, such as their password or User data.

The User will have access to instructions for use of the platform in the "Use of the web" area.

The User may receive the following notifications:

  • Upon registration on the platform (account validation email).
  • Those necessary to manage purchases or contracts, such as supporting documents, incidents, renewals, etc.
  • When a client of the User has completed a questionnaire (includes a report, in "pdf" format, with the result of the questionnaire and an assessment).
  • For password recovery.
  • Upon unsubscribing or deleting the account.

The client may also receive notifications, such as a link to access the questionnaire or a confirmation that they have completed it.

Security Measures

Users of this website are informed that "Instituto de Comunicación" has adopted the technical and organizational security measures within our reach to prevent the loss, misuse, alteration, unauthorized access, and theft of data, and thus guarantee the confidentiality, integrity, and quality of the information contained therein, in accordance with current data protection regulations. The personal data collected through the forms are processed solely by the staff of "Instituto de Comunicación" or by the designated Data Processors.

The website of "Instituto de Comunicación" also has SSL encryption, which allows the User to securely send their personal data through the contact or registration forms on the website.

Accuracy of the Data

The User declares that all data provided by them are true and correct and undertakes to keep them up to date. Exercise of User Rights

The LOPD and GDD and the GDPR grant data subjects the possibility of exercising a series of rights related to the processing of their personal data. To do so, the User must contact us by email at info@institutodecom.es, or by written communication to the address shown in our Legal Notice, providing appropriate identification. Such communication must include the following information: the User's first and last name, the purpose of the request, their address, and supporting identification.

The exercise of rights must be carried out by the User themselves. However, they may be exercised by a person authorized as the User's legal representative, providing documentation proving such representation.

The User may request the exercise of the following rights:

  • Right to request access to personal data, which is the right to obtain information about whether their personal data are being processed, the purpose of the processing being carried out, where applicable, as well as the available information on the origin of such data and the disclosures made or envisaged regarding them.
  • Right to request rectification, if the personal data are incorrect or inaccurate, or erasure of data that are inappropriate or excessive.
  • Right to request the restriction of processing, in which case only the data strictly necessary for the exercise or defense of claims will be retained by "Instituto de Comunicación".

Data Retention

The personal data of Users who use the contact form or who send us an email requesting information will be processed for the time strictly necessary to respond to the information request, or until the consent granted is withdrawn.

The Customer's personal data will be processed until the end of the contractual relationship. The retention period for personal data will be the minimum necessary and may be maintained for up to:

TERMS OF SALE AND CONTRACTING

These Terms govern the use of the web platform https://sikkhonamodel.es/, for which 2009 Instituto de Comunicación, S.L. is legally responsible, hereinafter, "Instituto de Comunicación". By accepting them, the User declares that they have read, understand and comprehend what is set out herein and that they assume all their obligations. If the User does not agree with the content of this document, they must leave this website and will not be able to access or use the services it offers. Likewise, the User expressly and without exception accepts that access to and use of this website, its services and the contents of such services takes place under their sole and exclusive responsibility.

These Terms shall be accepted by the parties without reservation, and may be modified at any time and without prior notice, it being the User's responsibility to read them when making a purchase or entering into a contract. The terms in force at the time the contract is entered into shall be those applicable to the User.

The "certified user" uses the website to purchase the reports they wish, register clients who have contracted them for the report production service, and send links to these clients so they can respond to the questionnaire.

The client uses the website to access and respond to the questionnaire they receive from the "certified user".

Once the client has responded to the questionnaire, the "certified user" uses the website to manage the reports produced, and they are recorded on the website in "pdf" format.

The user may cancel their account at any time by sending an email to info@institutodecom.es, or by contacting us by telephone.

The account does not expire automatically. If a user has not used their account for a period of more than two years, they will be contacted to find out if they are still interested, and otherwise their account will be cancelled, with their knowledge and consent.

User Registration and Correction of Errors

In order to use this website and, where applicable, enter into contracts, registration is required through the creation of a "User Account". After attending a training course on the use of the model and the platform, the User receives an email with a link to access the website, as well as the username and password.

From the User Account, you will be able to check your billing history, change your password, carry out other procedures or management tasks related to your contracts, check your personal information and, where necessary, correct any errors that may have occurred when entering the data (or update it).

Upon registering, the User undertakes to use this service only for private purposes and not for commercial purposes, except with the express consent of the Controller of this website.

User Profiles

There are two types of User profile:

  • Student Profile: "certified clients" are the persons who wish to purchase the questionnaires. Upon registering, the "Client", the "Certified" user and the "One Shot" user undertake to use this service only for private purposes and not for commercial purposes. Upon purchasing a questionnaire, and after payment, they will have access to its materials through the User area. Once the questionnaire has been completed, the "Client" and/or "One Shot" user will receive a result, and will be able to download it from the website.
  • Professional Profile: "Administrators" will be able to access the platform to supervise Users and monitor completed questionnaires. It may only be used by the owners of the platform. "Administrators" will be able to resolve queries and incidents, and have access to the data of other Users.

Service Contracting

The "Certified" User has access to the website after having received training, with no obligation to purchase. If the "Certified" user decides to purchase credits, this purchase is made through a payment platform.

The payment transaction does not entail any commission for the User. The service plans and their corresponding prices will be displayed in advance before contracting the service.

Restricted content will be accessible once the User registers and purchases one of the available plans. Memberships are for individual use, so the User is not permitted to authorise persons other than the User to use their account, and sharing access credentials with any third party is not allowed.

When contracting the service, an electronic contract is formalised, entered into under Spanish legislation and specifically under the legal regime imposed by Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE) and by Law 03/2014, of 27 March, General for the Defence of Consumers and Users (LGDCU).

The electronic contract will not be archived by a third party and the language for its conclusion is Spanish. These Terms may be saved and reproduced at any time by the User who enters into a contract using their internet browser options, and must be accepted before proceeding to payment for the services.

The contracting or purchase process at "Instituto de Comunicación" is very simple. Select the credits you wish to purchase, accept these Terms and choose the payment method from among those offered (see following sections).

Once the contract has been formalised, we will send you an email detailing its terms, as well as proof of purchase or invoice in digital format. If you do not receive this email within 24 hours, or if you notice any error in the data entered, please contact us by any of the following means:

Likewise, if you have not given your consent for us to send you the invoice in electronic format, you will receive a paper copy at no additional cost. Otherwise, you may revoke your consent by contacting us through any of the means mentioned above.

Service Renewal

The system operates on a pay-per-use basis, so there are no renewals or periodic payments.

Credit or debit card

Payment by credit or debit card is made through the bank's secure payment gateway. Through this payment method, "Instituto de Comunicación" never collects or handles any customer data relating to their card number. All data are processed directly by the bank, so that "Instituto de Comunicación" can always offer the greatest security, transparency and confidentiality in the transaction.

PayPal

Make the payment through the PayPal gateway. Through this payment method, "Instituto de Comunicación" never collects or handles any banking data. All data are processed directly by PayPal, so that "Instituto de Comunicación" can always offer the greatest transparency, security and confidentiality in the transaction.

Prices, Taxes and Fees

The prices of the services will be displayed before purchasing credits. They are expressed in Euros.

The final price of the contracted services may vary depending on the applicable taxes in each case, or depending on the buyer's address and profile (individual or professional). Except for those activities not subject to or exempt from VAT, the following taxes will apply on our website:

  • The retail price of services provided to clients whose billing address is in mainland Spain and the Balearic Islands includes VAT in all cases.
  • The retail price of services provided to clients whose billing address is in other EU countries, where the buyer is a natural person (individual), includes the VAT corresponding to the service provider's country.
  • The retail price of services provided to clients whose billing address is in other EU countries, where the buyer is a company or professional, does NOT include VAT if registered in the ROI (Register of Intra-Community Operations). Otherwise, the service price will include the VAT of the service provider's country.
  • The retail price of services provided to clients whose billing address is in the Canary Islands or Ceuta and Melilla and, in general, any country outside the EU, does NOT include VAT, as the transaction is treated as an export. The price indicated for each service is the final price.

Account and Service Cancellation, Termination and Blocking

User accounts are not deleted due to lack of use. Users may cancel their account by requesting it from "Instituto de Comunicación" staff, by sending an email to info@institutodecom.es or through their account profile.

The service will remain active as long as the amounts accrued for its use are paid on time and in full. If the User cancels the service during a period, no refund will be made for the unused time.

In the event of non-payment for the service, it may be temporarily suspended until the non-payment situation has been resolved by the User. If more than 15 days elapse, the service will be cancelled, which does not exempt the User from paying the proportional part of the service they were able to use before its suspension.

"Instituto de Comunicación" reserves the right to block access to the service without prior notice (or directly delete the User account) if it is used illegally, the obligations and rules established herein are breached, or the application is misused, which will be communicated by email. Blocking or deletion of the User account will have no effect on the obligation to pay for the service purchased if it has already been provided, where applicable.

In exceptional cases, at the sole discretion of the administrators of "Instituto de Comunicación", and assessing the seriousness of the matter, the administrators may choose to warn the infringing user before permanently deleting or blocking their account.

If a user has not used their account for a maximum period of two years, "Instituto de Comunicación" will contact you to find out if you are still interested. If "Instituto de Comunicación" is unable to contact the User, it reserves the right to cancel that account.

By registering as a User, you agree that the owners of this site reserve the right, and may act at any time and without prior notice, to modify or discontinue this website and its services, or to delete data provided, either temporarily or permanently.

Returns

At "Instituto de Comunicación" we want you to be satisfied with the services contracted with us. Therefore, we provide you with the option to cancel them, while they have not been provided, and if they do not meet your needs or expectations, in accordance with the provisions of the LGDCU.

Where applicable, the right of withdrawal must be exercised within a maximum period of FOURTEEN (14) calendar days from the date of contracting. You must notify us, without needing to give any reason, of your decision to withdraw from the CONTRACT entered into through an unequivocal statement, by any of the following means:

  • Fillable withdrawal form (available upon request or in the documentation provided)

To meet the withdrawal deadline, it is sufficient for the communication relating to the exercise by you of this right to be sent before the corresponding deadline expires. Once we receive your request, we will send you an acknowledgement of receipt on a durable medium, for example, by email.

In order to exercise this right, the service must not have been started. If it has been started, it will be considered performed upon contracting the service, so the right of withdrawal established in Law 3/2014, of 27 March, on the Defence of Consumers and Users will not apply.

We remind you that, under regulations, this right may not be exercised over digital products/services once download or use has already begun, unless that possibility is specifically indicated.

The refund of the purchase amount will be made once the status of the contract has been verified, through the same payment method used for the purchase and, in any case, before 14 calendar days have elapsed since receipt of the valid withdrawal request.

On the other hand, the "Certified" User may remove an end client before they have responded to the questionnaire, recovering the amount for that report.

Dispute Resolution

If you have any incident, complaint or claim related to a purchase made on our website, you may contact us at info@institutodecom.es or at C/ Calvet, 25 ppal. 2 - 08021, Barcelona - Spain. We will respond to your claim as soon as possible and, in any case, within the maximum period legally provided.

Applicable Law and Jurisdiction

These terms shall be governed by Spanish law.

In the event of a dispute, you may resort to the courts and tribunals that are competent in accordance with the applicable regulations.
